Agreement Required at Checkout. By completing a purchase, booking, or registration through our website or scheduling platform, you confirm that you have read, understood, and agreed to these Terms & Conditions in their entirety. Agreement is required to complete any transaction with Design 2 Move Pilates. If you do not agree, please do not proceed with your purchase.

These Terms & Conditions of Purchase and Use ("Terms") apply to all persons who purchase, book, or participate in any class, series, workshop, private session, or package ("Purchaser") from Design 2 Move LLC (dba Design 2 Move Pilates, "Studio," "we," "us") — whether directly or through a third-party scheduling platform. By accessing our website at www.d2mpilates.com or completing any purchase or booking, you agree to be bound by these Terms.


Section 1: Electronic Agreement & Acceptance

These Terms constitute a legally binding agreement between you and Design 2 Move LLC. Your agreement is captured electronically at the time of purchase or booking through our scheduling platform, which records a timestamped acceptance of these Terms. This electronic acceptance is valid and enforceable under the Arizona Uniform Electronic Transactions Act (A.R.S. § 44-7001 et seq.).

By completing checkout, booking a session, or attending any Studio activity, you represent that: (i) you are at least 18 years of age, or are the parent or legal guardian of a minor participant; (ii) you have the legal authority to enter into this agreement; and (iii) you have read and agree to these Terms in full.

If you are booking on behalf of a minor, you represent and warrant that you are the minor's parent or legal guardian, and that you are agreeing to these Terms — including the Waiver, Release, and Indemnity provisions — on behalf of both yourself and the minor.


Section 2: Fees and Payments

Purchaser's Obligation

Purchaser shall not be relieved of the obligation to make agreed payments. No deduction shall be made because of Purchaser's failure to use Studio facilities or attend scheduled sessions.

Form of Payment

Design 2 Move Pilates is a cashless studio. We accept ACH bank transfer (preferred), Mastercard, Visa, Discover, and American Express. All payments are processed through our secure third-party scheduling and payment platform. By authorizing payment, Purchaser consents to charges for all authorized transactions, including classes, packages, memberships, retail, late cancellation fees, and no-show fees.

Package Expiration

All class packages, session packs, and introductory offers expire six (6) months from the date of purchase unless otherwise stated at the time of purchase. Expired sessions are non-refundable and non-transferable. Membership terms and expiration are governed by the applicable membership agreement.

Membership Cancellation

Active memberships may be cancelled with a minimum of 30 days written notice submitted to studio@d2mpilates.com. Memberships may be frozen for a maximum of 60 days per calendar year with advance written notice. No refunds will be issued for partial billing periods. The Studio reserves the right to cancel or modify membership offerings with 30 days' notice to active members.

Returned Payment Penalty

Purchaser will automatically be charged any bank fee imposed on the Studio, plus a processing fee, for any returned payment due to closed accounts, insufficient funds, or similar issues. The Studio retains the right to collect current and past due balances in any subsequent billing cycle.

Disputed Charge Penalty

If a Purchaser initiates a credit card dispute that is subsequently resolved in the Studio's favor, the Studio shall have the right to charge Purchaser up to $50 per occurrence, plus any chargeback fees imposed by the payment processor.


Section 3: Cancellation Policy

24-Hour Cancellation Required. Design 2 Move Pilates requires a minimum 24-hour advance notice to cancel or reschedule any private session or group class. Late cancellations and no-shows will result in forfeiture of the session or class. There are NO EXCEPTIONS to this policy.

Class reservations are valid only if you are present and ready in the Studio within 5 minutes of the class commencing. In fairness to all clients, spots will be released 5 minutes after class starts.

Cancellations must be made through your account on the scheduling platform. Cancellation requests made by phone, email, or social media cannot be guaranteed to be processed in time and do not constitute a valid cancellation.

If a class is full, you may join the waitlist through the scheduling app. If a spot opens at least 24 hours before the class begins, you will be notified by email and must confirm within 2 hours to secure the spot. Failure to confirm within 2 hours will result in the spot being offered to the next person on the waitlist.

Sessions and classes are non-refundable and non-transferable. You are purchasing access to a class or session, not the services of a specific instructor. Instructors and class schedules are subject to change without notice and do not constitute grounds for a refund or credit.


Section 4: Health, Safety & Assumption of Risk

Medical Consultation Recommended

Purchaser is strongly advised to consult with a physician or undergo a physical examination before using the Studio's facilities or enrolling in any classes — especially if Purchaser is elderly, pregnant, has a history of heart disease, high blood pressure, chronic illness, or any physical limitations that could create an increased risk of injury from strenuous exercise.

Purchaser is strongly encouraged to complete a Private Pilates Session prior to joining group classes to ensure the proper and safe use of all Studio equipment.

Health Information & Privacy

In order to provide safe and appropriate instruction, the Studio may collect health and medical history information from Purchaser, including information about injuries, surgeries, chronic conditions, and physical limitations. This information is used solely to design safe and effective programming for Purchaser. The Studio will not share Purchaser's health information with third parties except as required by law or as necessary to coordinate care with Purchaser's healthcare providers with Purchaser's consent. Purchaser's health information is stored securely and in accordance with applicable law.

Purchaser's Health Warranty

By enrolling or participating in any Studio class or using Studio facilities, Purchaser represents and warrants that they: (i) are in good medical and physical condition and that participation does not pose any danger to their health; (ii) have no medical or physical conditions that would preclude participation or create an increased risk of injury; and (iii) have not been instructed by any physician against participating in strenuous physical exercise. Purchaser agrees to immediately notify Studio staff of any change in health status that may affect their ability to participate safely.

Assumption of Risk

Purchaser acknowledges that participation in the Studio's classes and use of the Studio's facilities involves inherent risks, including but not limited to strained, sprained, or torn muscles, tendons or ligaments, broken bones, dislocation of joints, concussion, brain damage, nerve and spinal cord injury, paralysis, and death.

By enrolling or participating in any Studio class or otherwise using Studio facilities, Purchaser willingly, knowingly, and voluntarily assumes all such risks, both known and unknown. The Studio cannot and does not guarantee that any facility, class, or equipment is free of risk of any accidents or injuries of any kind.

Medical Disclaimer

The Studio makes no claims as to medical or fitness results that can or may be obtained through use of the Studio's facilities, equipment, or services. The Studio has neither suggested nor will suggest any medical treatment to Purchaser. Only licensed medical professionals are qualified to give medical advice.

Waiver, Release, and Indemnity

By completing checkout or attending any Studio activity, Purchaser, on behalf of themselves and their heirs, assigns, and legal representatives, expressly agrees to forever discharge, waive, and release Design 2 Move LLC, dba "Design 2 Move Pilates," and each of its subsidiaries and their respective members, officers, directors, affiliates, instructors, agents, employees, and independent contractors (collectively, the "Released Parties") from any and all claims, demands, injuries, liabilities, actions, and causes of action — including acts of active or passive negligence — arising from any injury, damage, death, or loss resulting from or connected with use of the Studio's classes, services, and facilities, including all Pilates reformers, Pilates chairs, Cadillac, barres, mats, props, or other equipment, lobby, bathroom, or other areas.

Purchaser further agrees, to the fullest extent permitted by applicable law, to defend, indemnify, and hold harmless the Released Parties from any and all claims, losses, and liabilities arising from their use of the Studio's classes, services, and facilities.

Note regarding minors: The enforceability of parental waivers of liability on behalf of minor children may vary under Arizona law. Parents and guardians signing on behalf of minors are advised to consult with legal counsel regarding the scope of this waiver as applied to their minor child.

Purchaser Conduct

Purchaser shall not use any Studio facility, service, or equipment in a way that endangers the health or safety of Purchaser or others. Purchaser shall be responsible for any property damage or personal injury caused by Purchaser or their guests. Purchaser agrees to abide by all Studio rules and regulations as currently in effect and as they may be amended from time to time.

Loss of Property

Purchaser is urged not to bring valuables onto Studio premises. The Studio shall not be liable for the disappearance, loss, theft, or damage to personal property, including items stored in cubbies or other Studio areas.


Section 5: Photography & Media Consent

From time to time, the Studio may photograph or record video of classes, sessions, or Studio activities for use in marketing materials, social media, the Studio's website, or other promotional purposes. By participating in Studio activities, Purchaser grants the Studio a non-exclusive, royalty-free, perpetual license to use Purchaser's likeness in such materials, unless Purchaser provides written notice to the Studio requesting to be excluded from photography or recording.

If you do not consent to photography or recording, please notify Studio staff in writing at studio@d2mpilates.com prior to your session.


Section 6: Studio Rules

Dress Code

Proper athletic attire is required. Non-slip grip socks are required for all Reformer classes and are available for purchase at the Studio. The Studio reserves the right to make the final determination regarding appropriate attire in its sole discretion.

Cubbies & Personal Items

Cubbies are provided for the convenience of participants during sessions only. The Studio will remove articles left in cubbies overnight and is not responsible for missing, stolen, or damaged items.

Pets & Bicycles

Pets and bicycles are not permitted in the Studio unless approved in advance by Studio management.

Children in the Studio

All children under 18 must be accompanied by a parent or legal guardian at all times unless participating in a supervised Studio activity. Children under 13 are not permitted without express written permission from Studio management. These Terms must be signed by a parent or legal guardian for any minor to participate in Studio classes or activities.

Guests

Guests are permitted in the Studio subject to applicable rules, fees, and schedules then in effect. All guests must register with Studio staff and sign the Studio's standard release agreement prior to participating in any activity.

Independent Contractors

From time to time, the Studio may make the services of independent contractors available to Purchaser. The Studio does not warrant or guarantee the quality of these services.

Special Events & Temporary Closures

The Studio may reserve its facilities for special events, competitions, or private functions. As a result of repair, maintenance, special occasions, or force majeure events — including but not limited to acts of God, pandemics, government orders, natural disasters, or other events beyond the Studio's reasonable control — the Studio may temporarily close or restrict use of its facilities without liability to Purchaser. Hours, programs, and services may be amended at the Studio's discretion with reasonable notice where practicable.


Section 7: Website Terms of Use

These Terms govern the use of all Design 2 Move Pilates websites, including https://www.d2mpilates.com. Anyone accessing these sites agrees to abide by these Terms. We may modify these Terms at any time, effective immediately upon posting. Continued use of the Site constitutes acceptance of the modified Terms.

License

The contents of our Site — including text, graphics, images, logos, icons, editorial content, software, and other material — are protected under United States and foreign copyright, trademark, and other laws. You may view and use the Site subject to these Terms. You may download or print information for internal, non-commercial use only. Reprinting or electronic reproduction for any other purpose is expressly prohibited without prior written consent from Design 2 Move LLC.

Disclaimer of Warranties

This Site and its information is made available "as is" without warranty of any kind, either express or implied. We make no guarantee that information on this Site is up-to-date, accurate, or complete. We disclaim any warranty that the Site will be free of interruption, viruses, or other harmful code.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to take reasonable measures to prevent unauthorized access and to notify the Studio immediately of any unauthorized use of your account.

Recovery Fees

The Studio reserves the right to charge recovery fees for damages incurred if you attempt to exploit or abuse Studio policies or the point-of-sale system, including but not limited to: creation of duplicate accounts, impersonation, purchasing new client offers more than once, redeeming multiple vouchers, theft of retail merchandise, or filing fraudulent chargebacks.

Account Termination

Design 2 Move Pilates may, under certain circumstances and without prior notice, immediately terminate your account and access to the Service. Cause for termination includes breaches of these Terms, requests by law enforcement, self-initiated deletion, discontinuance or modification of the Service, technical or security issues, extended inactivity, fraudulent or illegal activities, or nonpayment of fees owed.


Section 8: Non-Discrimination

The Studio will not discriminate against any person because of gender, race, creed, age, color, sexual orientation, national origin, ancestry, disability, or any other characteristic protected by applicable federal, state, or local law.


Section 9: Governing Law & Dispute Resolution

These Terms shall be governed by the substantive law of the State of Arizona, without regard to its conflict of law principles. Before initiating any formal dispute, Purchaser agrees to provide the Studio with written notice of the dispute and allow 30 days for the Studio to respond and attempt resolution in good faith.

If the dispute is not resolved informally, Purchaser hereby unconditionally consents to submit to the jurisdiction of the federal and state courts sitting in Maricopa County, Arizona — or, at Design 2 Move Pilates's sole election, to binding arbitration before a single arbitrator pursuant to the American Arbitration Association's Commercial Dispute Resolution Procedures, with arbitration to take place in Phoenix, Arizona.

Prevailing Party

If Purchaser commences an action against the Studio and fails to obtain judgment in Purchaser's favor on all claims, Purchaser shall be liable to the Studio for all costs and expenses associated with the Studio's defense, including reasonable attorneys' fees and costs.

Costs of Collection

Purchaser agrees to pay all costs plus reasonable attorney and collection fees in connection with the Studio's collection of any amounts owed by Purchaser.


Section 10: General Provisions

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such holding shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect. The invalid provision shall be deemed modified to give it the maximum effect permitted by applicable law.

No Waiver

No failure or delay by the Studio in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise preclude any other or further exercise of such right.

Entire Agreement

These Terms and all Studio rules and regulations, as revised from time to time, constitute the entire and exclusive agreement between the parties and supersede all prior promises, representations, understandings, and agreements relating to the subject matter hereof. This agreement may be modified only by the Studio in writing.

Changes to Terms

Design 2 Move Pilates reserves the right, in its sole discretion, to change these Terms at any time. The most current version will supersede all previous versions and will be effective immediately upon posting at www.d2mpilates.com/terms. We encourage you to periodically review these Terms to stay informed of updates. Continued use of the Studio's services following any update constitutes acceptance of the revised Terms.
